Read through you insurance agreement (if you kept it else get one from your company) to see what is covered and what is not. Generally basement damage should be covered - get a second opinion from independent claims adjusters - you can get a list in any yellow pages (www.bigyellow.com). Complaining to the department of insurance may or may not help your case but may bring the company under audit (www.bestinsurancevalue.com).

: Downspout from roof gutter sustained hidden damaged due to winter freeze up.

: Springtime rains where not properly directed to storm water piping due to damage and water infiltrated the finished basement causing $4-5K damage.

: Encompass Ins states that winter freeze damage and subsequent basement water damage are two separate events and coverage for basement damages (2nd event) are denied.

: Coverage for first event is accepted for repair costs to downspout (about $8) which are below deductible.

: Encompass statee there is no appeal to their decision.

: What can I do to pressure them to reconsider?
