UNUM paid $26,000 too much in benefits on a disability policy to my friend with Leukemia. The overpayment, made over a 2 year period, has been spent on hospital and medical bills. My friend has been unemployeed due to his condition for a year, and his only income is the social secruity he collects. UNUM calims the amount of social security being collected is considered an "off set" in the policy, and therfore the benefit paid should be reduced by the amount of social security being collected. The state insurance department told me UNUM has the right to recover the $26,000. My friend can't afford legal fees or the stress being caused by the request for recovery. What courses of action are available to him?
