I am a retired insurance adjuster. I can assure you that you are not alone. A few things to consider for the future. If you have your own collsiion coverage, use it. You are less likely to get treated like that from your own insurance company and they will pursue the responsible party for your damages, including your deductible. in regards to your medical situation, I am not familiar with Texas State Law, but in some states you can only collect medical expenses and lost wages from your own carrier. The 16k they offered you was for 'pain and suffering'. I am not promising anything, but usually an attorney can get more money simply by filing suit. ALso if you feel the company is violating the unfair claims act, advise the State Insurance Department. The company cannot simply 'blow them off'.
