During a heavy wind and rain storm in December, 1996
a neighbor's 125 foot pine tree uprooted and crashed
into my yard. The tree knocked over a Canary
Island Date Palm, a 600-year-old oak tree and a
a power pole which dominoed into my neighbor's
yard across the street. My front yard and landscaping
was destroyed and it took several months to clear
out the debris at great expense. I filed a suit
against the neighbor's insurance company GOLDEN
EAGLE INSURANCE. The company took a nose dive into
bankruptcy and has been fighting this claim ever
since. We are scheduled for trial and it doesn't
make sense. All I wanted was to be reimbursed for
the $30K it has cost to clear the yard and get it
relandscaped. The cost to replace the tree is
$70K, but I am so sick of this, I am ready to
redesign the yard and be happy with the 30K which
they are fighting tooth and nail. I never thought
it would get this far. Another thing that is
bizaar is that at this late date, just a month
away from the trial, Golden Eagle's counsel is
holding depositions with my neighbors. Is this
a good point for our side or bad. Oy veh, when
it rains, it pours --cliched out. tweemz
