Unum has an obligation to pay its claims, regardless of what your SS status is. If they have stopped paying benefits and you're still disabled, whether or not you receive SS is immaterial unless specified in your policy. And my guess is that you won't find language that requires you to apply, and receive, SS as a condition for stopping payments.

You should apply now for SS, even if you don't think you have enough credits. The application process takes a long time and I understand that you need to be disabled for 6 months to qualify. You can apply on-line at:
https://s3abaca.ssa.gov/pro/isba3/wwwrmain.shtml

Did Unum give you any other reason for denying your benefits? Were you otherwise notified that your benefits would be terminated if you did not apply for SS? if not, you may have cause for legal recourse.

: several months ago I broke both legs which resulted so far in one complete knee replacement..I have osteoarthritis...my employer has already fired me..Unum has paid disability since May until now...they want me to file for SSI...problem is I don't have enough credits to collect (was off work for a few years in the mid-nineties). I don't know how to handle this exactly..my contension is I had arthritis when they took me on as a client (thru my employer) they haven't ever turned down the premium because they might have to pay-up someday and the knee surgery is a result of complications of an accident when I was employed and covered by their insurance. My doctor is backing me 100% but it doesn't seem to matter. Any advice how to handle these people..do I need a lawyer???
