: several months ago I broke both legs which resulted so far in one complete knee replacement..I have osteoarthritis...my employer has already fired me..Unum has paid disability since May until now...they want me to file for SSI...problem is I don't have enough credits to collect (was off work for a few years in the mid-nineties). I don't know how to handle this exactly..my contension is I had arthritis when they took me on as a client (thru my employer) they haven't ever turned down the premium because they might have to pay-up someday and the knee surgery is a result of complications of an accident when I was employed and covered by their insurance. My doctor is backing me 100% but it doesn't seem to matter. Any advice how to handle these people..do I need a lawyer???
UNUM simply wants you to ask for Social Security Disability, it doesn't matter about the credits etc. Get a copy of your policy, most likely your required to ask for Social Sec. Disability so that UNUM could get reduce the amount they pay you which most likely is allowed under the contract. In any event the money coming to you will be the same. Also, it doesn't matter that you were terminiated from your employment as long as on the date of disability you were disabled. If they are paying you, I don't see that you would need an attorney, unless one doing Social Security because Policy of Insurance may require Appeal. A social sec. determination in your favor would also help your case with UNUM. As soon as UNUM indicates that they are going to cut off payments contact an attorney if you disagree.
