[100 Insurers Message Board] [FAQ]

Posted by wt on 19:24:59 9/29/2003:

: I have never ever seen a company put a wrecking company on a settlement draft. Never. period. They are not a party to the insurance contract and there is no duty to pay them (other than an item of damages or part of the claim). Every company for which I have worked has paid the wrecking company direct.

: Second, it seems unusual, with their miriad of offices, that Allstate would not settle this in person, exchanging your title for the settlement draft. I would certainly demand that, were it my claim. I have occaisionally (and many times with represented claimants) sent settlement drafts to 3d party claimants with PD releases and usually would send payment to an insured before receiving their title. At the least, I would offer to meet with an insured in person to exchange the two, if the company will not allow it.

: You have been more than reasonable
