There is a relatively new coverage you can purchase called uninsured motorist property damage coverage. That would cover damage to your car (whether you carry collision coverage or not) caused by an at-fault uninsured motorist. Otherwise your colllision coverage is all you would have available, regardless of fault and subject to your deductible.

The only way you will receive your deductible back would be if you had the above coverage or the insurance company is able to recover from the uninsured driver. Just because he didn't have insurance does not mean they will not go after him
