In rear-end collisios you can expect to hear that in cases similar to yours that you are expected to keep your vehicle under control at all times.

If he hit you while changing lanes when he cut you off you would have a good case. Since you did not mention that he hit you and he was totally in the lane infront of you when he jammed his breaks on, I would suggest you talk to your insurance company first before you do anything.

If there was a police report of the accident that may help you determining who was at fault even though you may live in a "No Fault Accident State". Most likely he is going to sue you for causing the accident to be reimbursed for the dedictible on his insurance because he did not hit you when he cut you off.
