The short answer: yes.

The storage charges in excess of a reasonable (lovely legal term there) amount of time are most likely your responsibility. Their position will be that you should have mitigated (minimized) your damages, and that leaving the car in storage when you knew charges were accumulating was not reasonable.

Question--is this YOUR insurance company or that of the person who hit you? If it were your company, get to a manager and explain your situation. You may get some consideration that way. Otherwise you may have to eat all or most of the charges.

Are they taking possession of the salvage? If they want it, the charges have to be paid first. If not, see if the tow yard will take the title in exchange for the charges. If they take a hard line, consult an attorney and see if your liability for the charges exceeds the value of the vehicle in any way; that is, can you just send them the title and be done with it whether they agree or not (used to be the case in Illinois, but that was 11 years ago).


: Can the Insurance Co claim a total loss on a auto and turn around and tell you the storage charges are yours responsibility. It has taken them a year to satisfy the claim
