The criminals at Wawanesa are at it again. My lawyer just notified me that they are stating that my wife did not have a compression fracture despite an MRI evaluation stating that she did have one. Just when you think that Wawanesa cannot go any lower in their criminally debased minds, they prove that they can go lower than anyone else in the automobile insurance industry.

This illegal behavior is not surprising, as they have been conducting themselves in a criminal manner from the very beginning. They (Katherine Malar, Claims Supervisor) have already falsely claimed an investigation was done 2 months after the accident without talking to the only witness listed on the police report. She tried to tell me she spoke to him, and I told her on the 9th of June 2003, that I had spoken to him the night before, the 8th of June, and that he stated no one from their company had contacted him about the accident. The people at the tow yard where my car was at told me that no one from the Wawanesa insurance company had even come to the yard to look at my vehicle. Only those from the estimate company only, no investigators. So how can one do an investigation without looking at the evidence and speaking to the witness, they can't it is a sham, a complete fraud. So she intentionally commits fraud and violated the laws governing good faith in refusing fair and equitable treatment for my wife's injuries,pain, and property damage caused by their negligent client who was cited for failure to yield the right of way.

Remember before their claims adjuster (Leah Miller) admitted to me that if a police officer had cited my wife they would have believed him, but because it was against their client failing to yield the right of way, they stated that the police officer was prejudiced and biased, and they were not going to believe anything he said in his report. I have contacted the officer and other police organizations about Wawanesa's comments, and their supervisors condoning this extreme prejudice against police officers in matters of accident police reporting in automobile accidents.

My wife is fed up with the conduct of such a disreputable company that Wawanesa has proven itself to be. We however have been in contact with others in the insurance industry and have relayed the conduct of Wawanesa to them. They have recommended going to the highest levels in the California State government and informing them of their inappropriate conduct in this matter.

Before I end this message I want to give advice for future readers who may have to deal with the same criminal conduct of Wawanesa or any other disreputable insurance companies. (1) Find the best competent laywer around, do not shop for them in the yellow pages. Look for those who have a record of winning cases against insurance companies. Research their company thoroughly on the internet as well, do the research. Then contact that lawyer immediately. (2) Refuse to talk to anyone at that insurance company. (3) If x-rays are taken at a medical center, have them read immediately with their results to you. (4) Have your lawyers set up a new appointment with experts in the xray/radiology field and ask for MRIs and CT scans which are more accurate. (5) If the results of the medical center differ, immediately contact them to have them re-read their films and offer a copy of your more extensive films for them to arrive at an accurate diagnosis, to prevent criminals in the automotive insurance industry from taking advantage of blunders of these hospitals to prevent you from getting fair compensation for your injuries.(6)
(7) Do not cash any checks sent to you by these insurance adjusters, cashing it is a contract stating that you accept their findings and will effectively end any chances of you getting proper compensation for everything. Keep records of everything, especially the estimate of damages to your vehicle. Wawaneesa's estimate contractor stated it would take $2,900 to fix my car, but some how in their math of 15% deducted somehow comes to $1,900 can be considered nothing less than a rip off. (8) Keep all records of your loss of pay from the accident and all appointments, the emergency room, lawyers meetings, etc. (9) Get all documents from your lawyer of the correspondece from the other insurance company so that when you report them to the insurance commissioner of your state or province that you live in, that way you have their criminal statements and conduct on paper. Report all violations and injustices done by these criminals and one day they might rejoin the human race and conduct themselves in a humane way to those who have suffered.
